Brazilian Company Stoned By RDNH Trying To Grab Topaz.com

A three-member panel of the World Intellectual Property Organization handed a Brazilian financial technology company a ruling of Reverse Domain Name Hijacking for its effort to use the UDRP process to hijack the domain name, topaz.com, which was registered more than two decades before accrued trademark rights in the mark. Those trademarks, registered between 2020 and 2022, are owned by Top Systems Brasil Software Financeiro Ltda., which specializes in the field of digital financial solutions. The trademark registrations are all limited to Brazil. Topaz.com was registered in 1998.

The panel, represented by members Marilena Comanescu, Martin Schwimmer and Wilson Pinheiro Jabur, seemed particularly off-put by the complaint, noting in their ruling, “[I]n the Panel’s view, Complainant has made a farce of this proceeding.”

The ruling was handed up July 28, 2025.
