Financial Technology Firm Guilty Of RDNH Trying To Take Three-letter WEX.com

Case Number: 1991413

Complainant: Wex, Inc.

Represented by: Matthew D. Stein, Pierce Atwood LLP

A financial technology firm that provides services largely to the trucking and transportation sector has been found guilty of Reverse Domain Name Hijacking for trying to transfer the domain wex.com using the UDRP process. Wex, Inc., based in Portland, Maine, claimed the domain was registered in order to capitalize on a trade name it claimed dated to 1989. The domain, itself, was registered in 1994, but no trademark for WEX existed at that time. Additionally, while Wex, Inc. does have a trademark for the “WEX” mark, in various formats, the first of these dates to 1999, five years after the domain was registered. A three-member panel of the National Arbitration Forum handed up its ruling of RDNH against Wex, Inc. on May 16, 2022.
