Turkish Auto Upstart Crashes Head-On Into RDNH Trying To Swipe Togg.com

Case Number: D2021-1949

Complainant: Türkiye’nin Otomobili Girişim Grubu (TOGG)

Represented by: Gün + Partners

An automotive upstart, based in Turkey, with ambitions to build electric vehicles, has been found guilty of Reverse Domain Name Hijacking in its attempt to steal the domain togg.com from its long-time registrant, who first acquired the domain in 2003. The company is officially named Türkiye’nin Otomobili Girişim Grubu Sanayi Ve Ticaret Anonim Şirketi, but uses the short name Türkiye’nin Otomobili Girişim Grubu, also abbreviated as the acronym TOGG. While TOGG has numerous trademarks that include the TOGG mark, the company, itself, was only founded in 2018, and none of its trademarks, obviously, predates its founding.

A single-member panel of the World Intellectual Property organization, with Matthew Kennedy as the panelist, denied the UDRP and handed up the RDNH ruling on September 1, 2021.
